SMOGDANCE '09, THE POMONA VALLEY FILM FESTIVAL:
RULES, TERMS AND CONDITIONS

  1. To assure consideration, entries must be received by 11/01/08. Late entries will not be considered.Entries should be mailed or hand-delivered to tHE dA Center for the Arts, 252-D S. Main St., Pomona CA 91766.Entry Fees are based on submission dates.
  2. Any moving picture in the mediums listed below will be considered, but all submissions must be in VHS or DVD. If the dA cannot obtain the necessary equipment to present the submission in a different format the contestant will be advised and be given an opportunity to make appropriate arrangements. We will accommodate DVD, Beta SP, VHS and miniDV.
  3. BY SUBMITTING THEIR ENTRY FOR CONSIDERATION, EACH CONTESTANT AGREES TO THE TERMS AND CONDITIONS LISTED BELOW.
  4. All films will be judged by judges to be selected the dA Center for the Arts. Entries will be judged based on artistic merit and originality. The judges will also determine whether the film qualifies under the category listed, what films will be presented at the festival, and prizes. No prize will exceed $100.00.
  5. The dA Center for the Arts is not responsible for lost or damaged films or submissions, or for any shortcomings in the festival presentation. The dA will make its best efforts to present each film in a clear and professional manner. The dA will return films which are accompanied by self-addressed envelopes with postage fully prepaid. NO ENTRIES OR FEATURED FILMS WILL BE RETURNED WITHOUT A PACKAGE PROVIDED WITH PREPAID POSTAGE.
  6. No films will be considered over a run time of 50 minutes. Each film will be considered under one of four categories set forth below. All decisions of the judges on this are final. All films considered for submissiom must be made after 2005.

  17. TERMS AND CONDITIONS: PLEASE READ CAREFULLY: The terms and conditions below are designed both to protect the filmmaker(s) and enable a non-profit, largely volunteer organization to put on this event. We feel that these rules are fair, and we invite your comments.

    By submitting their entry, the individual(s) signing the entry form agrees to the following:

    (a) They are the primary filmmaker or filmmakers, or have permission to submit the film on behalf of the primary filmmakers.

    (b)They give permission to screen the film once only at the Pomona Film Festival at no charge, and they have the legal right to give such permission. This permission may not be revoked except by notice in writing received by The dA Center on or before the entry deadline, November 1, 2008.

    (c) The filmmaker retains all other copyright and other rights, except that The dA Center for the Arts has no responsibility for the safekeeping of the submission sent with the entry form, except to return the submission (if not lost or damaged) in a self-addressed stamped envelope or other container should the filmmaker choose to provide one.

    (d) The dA Center for the Arts will select the festival judges. All decisions of the judges are final regarding screening selections, prizes or anything else are final.

    (e) While The dA will strive to put on a great event in a non-commercial setting, no warranty is made regarding the quality of the festival or exhibition of any entry, if shown.

    (f) The dA Center will make a reasonable effort to assure the safekeeping and safe handling of any films or other media submitted for screening at the festival, but cannot guarantee against loss, theft, shred-happy equipment etc.. In other words, don't send us your only print.
